The Constitutional Court says the Speaker of the National Assembly must decide on a secret ballot in the interest of all South Africans as there is no legal for basis for the court to order this.
The UDM, which is supported by other opposition parties, brought the application. President Jacob Zuma and National Assembly Speaker Baleka Mbete were cited as the main respondents in the case.
Last month, Mbete postponed the no-confidence motion, which was initially scheduled for April the 18th, to allow the court to hear the UDM's application and make a ruling.
Delivering the judgement at the Constitutional Court, in Johannesburg, Chief Justice Mogoeng Mogoeng says Parliament must hold the executive accountable. Mogoeng Mogoeng says the National Assembly speaker Baleka Mbethe has the "constitutional powers" to order a secret ballot in a case brought by the country's opposition parties
